Rentafone Japan Customer Service Agreement

Rentafone Japan and the customer agree to the following :

Introduction
1.a   Rentafone Japan will supply the customer with a working cell phone (for short-term use in Japan only ) and charger, both of which will remain the property of Rentafone Japan throughout the rental period.
1.b   The phone will be delivered to the customer’s preferred location (the customer’s place of stay in Japan ; an address in the customer’s home country ; airport post office  in Japan ; or another location  by agreement) on / by a date specified by the customer.
However, Rentafone Japan reserves the right to refuse to send to any specific place if it is deemed that delivery will be problematic.
1.c  Rentafone Japan will inform the customer of the phone number of the rental phone by e-mail before sending the phone to the customer.
Where possible this will be done a week in advance, but Rentafone Japan reserves the right to inform the customer of the number just before sending the phone during busy periods.
1.d The customer will return by mail the cell phone and charger in the stamped addressed envelope provided with the phone at the end of the rental period.

 

Rental period
2.a   The “rental period” in this agreement is determined as the period from the “rental start date” (the delivery date specified by the customer on the order form) and the “rental end date” (the return  date specified by the customer on the order form – the date on which the customer will post back the cell phone to Rentafone Japan).
Shipping time , both to the customer and back to Rentafone Japan, is not included in the Rental Period.

2.b    Both the rental start date and rental end date are included in the rental period.
(e.g. a rental start date of Jan 1 and a rental end date of Jan 7 is determined as a rental period of 7 days
2.c    If the customer wishes to extend the rental period, (s)he shall inform Rentafone Japan before the rental end date.
In principle, extending the rental period will be permitted, but Rentafone Japan reserves the right to refuse the customers request and ask for return of the cell phone on the original rental end date.
2.d   If the customer wishes to return the phone earlier than anticipated, the rental period shall be deemed as ending on the date the customer sends back the phone, and will be charged accordingly.
2.e   If the customer returns the phone late, Rentafone Japan has the right to include the days between the rental end date and the actual date of return as an extension of the rental period.
The date of the postmark on the return envelope will be judged to indicate the actual date of return.
2.f    If the phone is not returned to Rentafone Japan within two weeks of the rental end date, and the customer does not contact Rentafone Japan , it shall be deemed lost.
The customer will be liable to pay for the full Softbank Mobile prepaid credit balance at the start of the rental, plus up to Yen 20,000 for the cost of a replacement phone (Rentafone Japan is unable to recover the Softbank Mobile prepaid credit balance in lost phones, but is able to recover the Softbank Telecom 006610 discount/ international (Comica) balance).

Charges
3.a   For a rental period of 7 days or less, there will be a rental charge of Yen 3900.
3.b   For a rental period of over 7 days, there will be a rental charge of Yen 3900 for the first 7 days, Yen 300 for each day over 7 days up to and including 20 days, and Yen 100 per day after 20 days.
3.c   Call charges are not included in the rental charge.
Call charges will be determined by the difference in the credit balances in the phone at the time of shipping by Rentafone Japan and the credit balances in the phone at the time of return receipt by Rentafone Japan.
The “credit balances” above refers to  the Softbank Mobile standard prepaid, and also the Softbank Telecom 006610 discount/ international (Comica) balances in the phone.
3.d   Current call rates are listed on the Rentafone Japan website.
In the event of a change in the rates by either Softbank Mobile or Softbank Telecom, Rentafone Japan will endeavour to inform the customer as soon as practical, but Rentafone Japan shall not be responsible for reimbursement of any difference between the new call rates and old rates in the event of the new rates being higher than the old (nor will Rentafone Japan charge for a difference in the event of the new rates being lower than the old).
3.e  Shipping charges within Japan are included in the rental charge, and a stamped addressed envelope is provided with the phone for return of the phone at the end of the rental period.
If delivery is requested overseas, an extra shipping charge of Yen 1000 will be applied.
3.f  Charges are in Japanese Yen, and are fixed without regard to changes in the value of other currencies.
Rentafone Japan may quote approximate costs quoted in other currencies , but these are for illustrative purposes only.

 

Billing
4.a   Payment is in principle by credit card.
4.b   Rentafone Japan will charge for the minimum rental charge of Yen 3900 before sending the phone (or Yen 3900 for each phone if more than one is ordered).
If  Rentafone Japan is unable to obtain credit card authorization, the customer will be contacted and asked to remedy the problem (by providing correct details if those supplied were incorrect ; contacting his/her credit card issuer if necessary ; providing details of a different credit card).
If Rentafone Japan is still unable to obtain credit card authorization, or if there is no reply by the customer, no phone will be sent , and this agreement will be voided.
4.c   Upon return of the phone, Rentafone Japan will charge for outstanding charges – charges for  extra days over one week ; calls made ; and any charges for loss/damage as indicated below.
4.d   If the customer believes that the charges made by Rentafone Japan are erroneous, (s)he will contact Rentafone Japan to discuss the discrepancy before contacting his/her credit card issuer.

 

Cancellation by customer
5.a   There will be no cancellation charge if notice of cancellation is received by Rentafone Japan more than 96 hours before the rental start date or if the phone has not yet been sent.
5.b    If notice of cancellation is received less than hours 96 hours of rental start date, and the phone has already been sent, there will be a cancellation charge of Yen 2000 ( the one-week rental charge of Yen 3900 having already been charged to the customer’s credit card, a Yen 1900 refund will be made).
5.c    If no notice of cancellation is received, and the phone has already been sent, but the phone is later retrieved by Rentafone Japan (for example , if sent to a hotel, and the hotel sends it back to Rentafone Japan unused, but with a note that the customer did not check in) , the full minimum charge of Yen 3900 will apply.

Termination of contract by Rentafone Japan
6.a   Rentafone Japan reserves the right to cancel this agreement if the customer’s use of the phone is deemed to be in breach of Japanese law, or where termination is deemed to be necessary to comply with the law.
6.b   In such cases, the cell phone and charger must be returned immediately to Rentafone Japan.
Rentafone Japan will charge for the rental period up to the date that the customer mails back the phone.
6.c  Rentafone Japan will not be held responsible for any losses incurred by the customer due to the termination of this agreement.

Loss/ damage
7.a   In the case of loss or theft, the customer shall contact Rentafone Japan immediately , and also report the loss to the relevant authorities (police ; station master ; etc).
Rentafone Japan will offer the customer a replacement phone - the customer will be liable for extra shipping costs.
7.b   If the phone is not found and returned to Rentafone Japan within two weeks of the rental end date, it shall be deemed lost.
The customer will be liable to pay for the full Softbank Mobile prepaid credit balance at the start of the rental, plus up to Yen 20,000 for the cost of a replacement phone (Rentafone Japan is unable to recover the Softbank Mobile prepaid credit balance in lost phones, but is able to recover the Softbank Telecom 006610 discount/ international (Comica) balance).
7.c   If the phone is returned to Rentafone Japan in damaged condition, the customer will be liable for the cost of repair.
7.d   If the phone charger is not returned or is returned in a damaged condition , a charge of Yen 1000 will be applied.
7.e   If the bag in which the phone was sent is not returned, a charge of Yen 500 will be applied.

 

Privacy
8.a  Rentafone Japan will destroy all records of the customer’s credit card details within two months of the return of the phone, and all charges being paid.
8.b  Rentafone Japan will not disclose any of the customer’s details (in particular the e-mail address) to any third party.

 

Limits of Liability
9.a  In all cases, the maximum liability that Rentafone Japan shall be held to is the refund of the rental charge.
9.b  Rentafone Japan will not be held responsible for any losses incurred due to forces of nature, war, riots and other factors unforeseeable and beyond its control.
9.c  In cases where the customer is unable to use the phone due to poor reception, the customer may  terminate this agreement (and there will be a full refund of charges made to the customer’s credit card before sending the phone).
Rentafone Japan will not be held liable for any extra cost incurred by the customer due to poor reception (e.g the cost of calls made from a public phone or hotel phone).
9.d  Rentafone Japan will not be held liable in any way for problems receiving / sending  e-mail other than if the phone is defective.
9.e  Rentafone Japan is in no way liable for any losses incurred by the customer due to misuse.
9.f  In the event of non-delivery at the specified location/date, Rentafone Japan will offer the customer a replacement, at no extra shipping cost, and a discount on the rental (the value of the discount to be determined on a case by case basis, at the discretion of Rentafone Japan).
If this is unacceptable to the customer, (s)he may terminate this agreement (and there will be a full refund of charges made to the customer’s credit card before sending the phone).
Rentafone Japan will not be held responsible for any losses incurred by the customer through non-delivery of the phone at the specified location/date.
However, if the customer has requested delivery at an erroneous specified location/date on the order form, the customer will be responsible for any extra shipping costs, and no discount will be applicable.
9.g  If a problem occurs with the phone, the customer will inform Rentafone Japan of the problem as soon as practical.
Rentafone Japan will then offer the customer a replacement, at no extra shipping cost, and a Yen 1000 discount on the rental.
If this is unacceptable to the customer, the customer may terminate this agreement.
In this case, there will be a full refund of rental charges made to the customer’s credit card before sending the phone if the phone has not been used for more than 24 hours (calls made will still be charged) ; if the phone has been used for more than 24 hours, Rentafone Japan will offer a discount of half the rental cost.
However, if the customer does not inform Rentafone Japan of a problem with the phone, the full rental charge will be applied.
9.h Informing the customer of the  phone number in advance shall be considered a courtesy  and not an integral part of the service – should it be necessary to change the phone and the number to be sent, Rentafone Japan will not be held responsible for any losses incurred.
